Gerry here is the reply from the Consuls office in Alicante its seems that we are anot covered until we are 65yrs or 60 in Lynns case I will cover it in AOB at the next meeting. So If you want to add this to the other reply from DHSS.

Dear Mr Peters
Thank you for your email regarding your application for a Spanish EHIC.
As the Department of Health stated, once your E106 cover expired and as you are not yet of in receipt of a UK state pension then you are not covered for health cover under the state run scheme of the UK. As you live in the Valencia Autonomous Community you are covered here through the Spanish state-run scheme under Circular 1/2002 which entitles UK residents in the region to health cover. Circular 1/2002 only applies to Valencia, which includes Orihuela, so you will also need to consider private health cover if you travelled outside the region.
The reason you are no longer entitled to cover in the UK is that this entitlement is based on residency in the UK. As you are resident in Spain you do not meet this criteria. Spanish state run health care is based on your contributory record. If you were to start working and contributing to the Spanish national insurance scheme then you would be entitled to health cover throughout the country.
In your current circumstances, you must consider private health insurance whenever you travel outside the Valencia Autonomous Community.
